By accessing or using www.diasparx.com (the "Site"), placing an order in a Diasparx boutique, or otherwise engaging with Diasparx (the "Company," "we," "us," or "our"), you warrant and represent that you are legally entitled to do so and to make use of the information, products, and services made available through the Site and our stores. If you do not agree to these Terms & Conditions ("Terms"), you must not use the Site or purchase from Diasparx.

These Terms apply to all visitors, customers, registered account holders, and any other users of Diasparx, whether accessed online, in a retail boutique, or through any Diasparx-affiliated application.

Conflict of Terms

If there is a conflict or contradiction between the provisions of these Terms and any other relevant terms and conditions, policies, or notices, the other relevant terms and conditions, policies, or notices which relate specifically to a particular section, program, or module of the Site shall prevail in respect of your use of that relevant section, program, or module.

Severability

Any provision of these Terms, or any related policy or notice, which is or becomes unenforceable in any jurisdiction, whether due to invalidity, illegality, unlawfulness, or for any other reason, shall, in such jurisdiction only and only to the extent that it is unenforceable, be treated as void, and the remaining provisions shall remain in full force and effect.

Account Registration & Security

Certain features of the Site, including order history, wish lists, and loyalty program access, require you to create a personal account. When registering, you agree to provide accurate, current, and complete information and to keep that information updated.

eCommerce & Online Purchases

All prices displayed on the Site are listed in U.S. Dollars unless otherwise stated and are subject to change without notice. Prices, availability, and product descriptions are subject to correction at any time, including after an order has been submitted, in the event of a pricing or typographical error.

Payment

We accept major credit cards, select digital wallets, and other payment methods as indicated at checkout. By submitting payment information, you represent that you are authorized to use the designated payment method and authorize us to charge the full order amount, including applicable taxes and shipping fees.

Order Confirmation

An order confirmation email indicates that we have received your order request; it does not constitute our acceptance of the order or a guarantee of product availability. Diasparx reserves the right to refuse, cancel, or limit any order at our discretion, including in cases of suspected fraud, pricing errors, or insufficient inventory.

Cancellations

Orders may be canceled or modified only within a limited window after submission, before the item enters production, engraving, or fulfillment. Custom, made-to-order, and engraved pieces cannot be canceled once production has begun. Contact [Contact Email] as soon as possible to request a change.

Shipping & Delivery

Diasparx ships to addresses within the United States and to select international destinations. Estimated delivery timeframes are provided at checkout and are not guaranteed, as they may be affected by carrier delays, customs processing, or circumstances beyond our control.

• Domestic Shipping: All domestic shipments are insured and require a signature for delivery on orders above a designated value threshold.
• International Shipping: International orders may be subject to customs duties, import taxes, and brokerage fees, which are the responsibility of the recipient and are not included in the item price or shipping cost.
• Risk of Loss: Risk of loss and title for items purchased passes to you upon our delivery to the carrier; however, Diasparx will assist with insurance claims for shipments lost or damaged in transit when insured shipping was selected.

Returns, Exchanges & Refunds

Eligible items may be returned or exchanged within 14 days of delivery for online purchases, or 14 days of purchase for in-store purchases, provided the item is unworn, undamaged, and returned in its original packaging with any accompanying certification, appraisal, or authenticity documents.

• Custom, engraved, resized, or special-order pieces are final sale and are not eligible for return or exchange unless defective.
• A restocking fee of up to 10% may apply to returned special-order or high-value items, as disclosed at the time of purchase.
• Refunds are issued to the original form of payment within 7 to 10 business days of our receipt and inspection of the returned item.
• Shipping charges are non-refundable, and return shipping costs are the responsibility of the customer unless the return is due to a Diasparx error or defect.

In-Store / Point of Sale Purchases

Purchases made at a Diasparx boutique are governed by these Terms in addition to any policies posted at the point of sale.

• Receipts: Please retain your original sales receipt, as it is required to process returns, exchanges, warranty claims, and repairs.
• Price Matching: Diasparx may, at its sole discretion, match the current advertised price of an identical, in-stock Diasparx item found on our own Site within 7 days of an in-store purchase. Price matching does not apply to third-party retailers, clearance items, or prior sale pricing.
• Layaway: Where offered, layaway requires a minimum deposit and completion of payment within the timeframe specified at the time of enrollment. Deposits on canceled layaway plans are non-refundable but may be issued as store credit at our discretion.

Product Descriptions & Accuracy

Diasparx endeavors to display accurate colors, dimensions, gemstone characteristics, and metal specifications for every piece; however, natural variation is inherent to fine jewelry and gemstones, and slight differences between the product received and its photographed representation should be expected.

• Gemstone grading (including clarity, color, and carat weight) is based on industry-standard practices and, where applicable, independent laboratory certification (such as GIA or an equivalent gemological authority).
• Metal purity is indicated by standard hallmarks (e.g., 14K, 18K, 950 Platinum) and reflects the alloy composition disclosed at the time of sale.
• Photography is enhanced for presentation purposes; actual sparkle, cut, and finish may vary slightly from images displayed on the Site.
• Diasparx reserves the right to correct any product description, pricing, or specification error at any time, including after an order has been placed.

Warranty & Repairs

Diasparx pieces are covered by a limited manufacturer's warranty against defects in materials and craftsmanship for a period specified on your original receipt or warranty card, typically one year from the date of purchase.

• The warranty does not cover damage resulting from normal wear, accidental loss, misuse, unauthorized repair, or exposure to harsh chemicals.
• Repair services, including prong retipping, resizing, and stone tightening, are available through our authorized service centers; estimates will be provided prior to any chargeable repair.
• Care Instructions: Store pieces separately to prevent scratching, avoid contact with perfume, chlorine, and household chemicals, and have prong settings inspected annually by a qualified jeweler.

Loyalty & Rewards Program

Diasparx's loyalty program allows enrolled members to earn points on qualifying purchases, redeemable toward future orders and exclusive experiences.

• Points are earned based on the pre-tax purchase amount and are credited to your account after order fulfillment; points are not earned on gift card purchases, taxes, or shipping.
• Redemption thresholds, reward tiers, and point values are described in the program's current terms, available upon enrollment.
• Unredeemed points expire after 12 months of account inactivity, or as otherwise disclosed in the program terms.
• Diasparx reserves the right to modify, suspend, or discontinue the loyalty program, or any portion of it, at any time, with reasonable notice to members where required by law.

Gift Cards & Store Credit

Diasparx gift cards and store credit may be purchased online or in-boutique and redeemed toward eligible merchandise.

• Gift cards are not redeemable for cash except where required by applicable law.

• Gift cards do not expire and no dormancy fees apply, except where a different policy is required or permitted by state law.
• Diasparx is not responsible for lost, stolen, or unauthorized use of gift cards once issued; treat your gift card like cash.

CRM & Customer Data

Diasparx collects customer information through both online interactions (account creation, checkout, browsing behavior) and in-store point-of-sale transactions, including name, contact details, purchase history, and preferences.

• This information is used to fulfill orders, personalize your shopping experience, manage the loyalty program, and inform relevant marketing communications and product recommendations.

If you enable push notifications through a Diasparx-affiliated application or browser prompt, you may receive alerts regarding order status, promotions, and events. You can disable push notifications at any time through your device or browser settings without affecting your ability to use the Site.

Intellectual Property

The trademarks, names, logos, and service marks (collectively, "trademarks") displayed on this Site are registered and unregistered trademarks of Diasparx and its parent company, LaNae LLC. All product photography, descriptions, graphics, and written content on the Site are owned by or licensed to Diasparx and are protected under applicable copyright and trademark law.

User-Generated Content

When you submit a product review, photograph, social media tag, or other content referencing Diasparx ("User Content"), you grant Diasparx a non-exclusive, royalty-free, worldwide, perpetual license to reproduce, display, and use that content across our marketing channels, including the Site, email, and social media.
